    Terms of Use

    Please read these Terms carefully before using VitalityX Services. By accessing or using our platform, you agree to be bound by these Terms.

    These Terms of Use ("Terms") constitute a legally binding agreement between you and VitalityX Health LLC ("VitalityX," "we," "us," or "our"), a Pennsylvania Limited Liability Company located at 798 Turnpike St., Beaver, PA 15009. These Terms govern your access to and use of our personalized health optimization platform, including genetic testing, biomarker analysis, health coaching, custom supplements, virtual training, the client portal, VX Clinical telehealth programs delivered through our clinical partner, and all related services.

    Our collection and use of your personal and health information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

    Who Provides Your Clinical Care

    Clinical services offered through VX Clinical are provided by independent licensed clinicians (nurse practitioners and MDs licensed in your state) through OpenLoop Healthcare Partners, PC and its affiliated professional entities (collectively, the "Medical Group"). VitalityX Health LLC is not a medical practice, does not employ the clinicians, and does not practice medicine. VitalityX provides the technology platform, program design, coaching, and the administrative and support services that connect you with the Medical Group. "Provider" in these Terms means an independent licensed clinician or professional entity that provides clinical services to you through or in connection with the Services.

    Before receiving clinical services you must review and agree to the Medical Group's Telehealth Consent, linked below. It identifies the professional entities that deliver your care and explains the benefits, risks, and limitations of receiving care by telehealth.

    Independent Clinical Judgment

    All treatment decisions — including whether any medication is appropriate for you — are made solely by your provider based on their independent professional judgment and the information you provide. Purchasing a VX Clinical program does not guarantee that you will be prescribed any medication. If your provider determines that a therapy is not appropriate for you, you will be refunded as described in our Cancellation and Refund Policy.

    Cancellation and Refund Policy

    Compounded Medications

    Some VX Clinical therapies involve compounded medications prepared by licensed pharmacies. Compounded medications are not reviewed or approved by the U.S. Food and Drug Administration for safety, effectiveness, or manufacturing quality. They are prescribed only when your provider determines they are appropriate for you, and every prescription requires clinical review.

    Not for Emergencies

    VX Clinical is not an emergency service and is not a replacement for your primary care provider. If you think you may have a medical emergency, call 911 or go to the nearest emergency room. If you are in crisis, call or text 988 (Suicide and Crisis Lifeline).

    Partner Pharmacies

    VX Clinical may facilitate prescription orders placed by your provider. Where applicable, prescriptions are fulfilled by one of the licensed partner pharmacies listed below ("Partner Pharmacies"), depending on the program, the medication, and your location. You authorize your provider and the Medical Group to transmit prescription information to one or more Partner Pharmacies for dispensing and shipment, as permitted by law. Any prescription order is at the professional discretion of your provider.

    Questions About Your Medication

    Please direct questions about your prescription, dosing, or your health to your provider through your VitalityX patient portal rather than to a Partner Pharmacy directly, unless you are instructed otherwise. Your care team will coordinate with the pharmacy on your behalf.

    Pharmacy Transfers

    Your prescription may be transferred among Partner Pharmacies for fulfillment, availability, pricing, or operational reasons, consistent with applicable law and your instructions.

    Shipping

    Shipping times are estimates and may vary due to pharmacy processing, verification, carrier delays, weather, holidays, or other factors outside our control.

    Temperature-Sensitive Products

    Certain medications require refrigeration or other special handling. You are responsible for receiving shipments promptly and following the storage instructions provided with your medication.

    Child-Resistant Packaging

    Some medications may ship in non-child-resistant packaging where permitted. Keep all medications out of reach of children.

    Services are available in all 50 states and Washington D.C. Medication and product availability varies based on clinical appropriateness, applicable federal and state laws, or other regulatory requirements. Not all therapies are available in all states. Availability is subject to change.

    Confirming Availability

    Your provider will confirm during your consultation which therapies are available to you based on the state in which you are located at the time of your visit. You must be physically located in a state where the relevant service is available when you receive care.

Our genetic analysis, biomarker reports, coaching, and supplement recommendations are for informational and wellness purposes only and do not constitute medical advice, diagnosis, or treatment.     Governing Law: These Terms are governed by the laws of the Commonwealth of Pennsylvania. By using VitalityX Services, you consent to the exclusive jurisdiction of the courts in Beaver County, Pennsylvania for any disputes not subject to arbitration.
